STOCK STATUS

The stock status of the items on the site represents the current availability of the item. Statuses are defined as:

• Available in store
• We have the item in stock at our store and can ship it out immediately.
• Ships from our warehouse for local pickup or have it shipped
• One of our distributor warehouses has the item in stock and it is available for immediate shipment.
• OUT OF STOCK
• We do not have any of this item in stock at the moment.

GENERAL FIREARM SALES

All firearms, magazines, receivers and restricted law enforcement items are sold and shipped in accordance with all existing federal, state and local laws and regulations. Many of the firearms, magazines and parts for sale on this website may be restricted or prohibited in your area. Please check your local and state regulations before ordering.

All new firearms are shipped in the original manufacturer's box, with magazine(s), accessories and applicable warranty. Firearms sales are final. Firearms requiring warranty work must be returned to the factory within 1 year of purchase for repair. Accessories and special order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package, unless we have guaranteed the entire package in writing. Please contact the original manufacturer for warranty information on all accessories and special order items.

USED FIREARMS 

Used firearms may not be returned. All sales are final. Description and photos (if available) are provided by the seller.

AMMUNITION PURCHASES

You must be 18 or older to purchase rifle or shotgun ammunition and 21 or older to purchase handgun ammunition. All ammunition will be shipped ground with adult signature required and sales on these items are final. Always make sure to use the correct ammunition for your specific firearms. Check your local laws for any other regulations. Customers are responsible and must follow all local, state and federal laws. Please research before ordering if you are unsure about your local laws..

AUTOMATIC KNIVES

The Switchblade Act, (Pub.L. 85-623, 72 Stat. 562, enacted on August 12, 1958, and codified in 15 U.S.C. § 1241–1245), as may be amended, (the “Act”) prohibits shipment of automatic knives across state lines, with the following exceptions:

PURCHASING FIREARMS ONLINE

It is illegal to ship firearms to anyone not holding an active Federal Firearms License (FFL). For that reason, firearms purchased online may picked up at our store or shipped to an FFL (gun store) near you. We may contact and verify the FFL you select during checkout before we ship your firearm(s). The buyer is encouraged to contact the receiving FFL licensee before purchase.

When the firearm is ready to be picked up at your FFL, Please INSPECT THE FIREARM THOROUGHLY to make sure it is what you ordered and that there are no defects with the firearm. If there are any problems, DO NOT ACCEPT THE TRANSFER. We will gladly have the firearm picked up and returned to us from your dealer and provide you with your choice of a REPLACEMENT or REFUND. Once you accept transfer from your dealer, the gun is considered used and must be returned directly to the manufacturer for warranty repair or replacement. There are no returns after a transfer has been accepted.

CHANGING, MODIFYING, SUBSTITUTING ORDERS

We like to serve customers best as possible and we understand that mistakes can happen. If you have placed an existing order and want to change it we can help you with that. The process is as follows: orders that need modified will be cancelled and the customer will be refunded the full amount minus a $10 charge via gift card. Once the customer receives the refund they can replace the order on the website. 1791 Headquarters WILL NOT place the order for the customer due to fraud and sensitive information that gets exchanged in transactions. At this point the transaction lead times have restarted.

RETURNS & CANCELED ORDERS

All canceled and returned orders will be charged a 15% restocking fee. All sales are final, included are firearms, ammunition, and optics. Any order that surpasses 21 days and we haven’t received the requested documents for your order. Your order will be canceled, and funds returned minus the 15% restocking fee.

If you are not satisfied with your purchase, please contact us within 15 business days of purchase. Original shipping fees are non-refundable. It is the buyer's responsibility to organize the return shipment of any returns. Items must be returned in the condition they were received. Used or items that have been opened cannot be returned.

Sales on the following items are final:

• Special orders.
• Products sold "as is" or "used" or that have been installed or used after receipt.
• Ammunition.
• Firearms.
• NFA items. o Illumination devices, electronic sights and optics.

ORDER FULLFILMENT

All orders are shipped promptly from a distributor warehouse or in-store inventory within 3 - 10 business days using UPS, FedEx, or USPS. Tracking numbers are available for items shipped via UPS and FedEx. Shipping is generally not performed on the weekends or on all Federal Holidays.

For product orders with a value of $100 or more (excluding shipping and taxes), shipping is free for most orders.  Some items have additional shipping costs that are not covered by the free shipping (i.e., oversized and overweight items).  These items are identified in the descriptions.  All other orders ship for a $10 shipping and handling fee. Our Flat rate shipping policy only qualifies for the lower 48 states. We currently do not offer shipping to states outside the lower 48 and international. If an order is placed outside of the stated perimeters it will be cancelled and issued a restock fee.

Orders cannot be processed and will be flagged as fraud if the billing and shipping address DO NOT match. Orders will then be replaced via gift card to place the order correctly. IF an order is for a serialized item or firearm the system will dictate it as such and it will be sent to the chosen FFL. DO NOT put the FFL as the shipping address.

There are some items that our distributor warehouses consider restricted and will not ship directly to a customer (i.e., upper receivers, etc.). In those cases, the item will be shipped to our store and then shipped to you. You will not be charged any additional shipping charges, if this occurs.

There are some areas within the United States of America where certain restricted items cannot be shipped (i.e., high-capacity magazines, defense sprays, automatic knives, stun guns, knuckles, police batons, etc.). These areas include, but are not limited to: portions of Alaska, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Indiana, Kansas, Louisiana, Maine, Massachusetts, Michigan, Minnesota, Missouri, New Mexico, New York, Tennessee, Texas, Vermont, Washington, and Wisconsin. Exceptions are made as local laws permit (proper ID may be required at the time of purchase).

All items purchased from this site are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. We insure all shipments and should a loss or damage occur in transit, we will file a claim on your behalf. Claim outcomes are not guaranteed. Buyers shall waive their rights to a credit card chargeback in the event of items lost or damaged during shipment.

PAYMENT

We accept Visa, Mastercard, Discover, and American Express. By ordering with a credit card you agree that you are authorized to use such credit card and, if there is a billing dispute, to handle any billing disputes directly with us.

We reserve the right to request identification for any purchases of any kind. No customer shall be obligated to provide identification, however failure to provide requested information may result in the cancellation of the customer's order. If the order is cancelled and charges to the credit card used will be voided or refunded.

ONLINE PRICE AND DESCRIPTION ERRORS

1791 Headquarters and its affiliates attempt to be as accurate as possible. However, 1791 Headquarters does not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free. Our online inventory changes every day. Occasionally an item may appear on the site by mistake or the item's description may contain a typographical error. We do not guarantee that inventory, titles, descriptions or pictures on our site are error-free.

We reserve the right to refuse any order including but not limited to orders for items with errors in the description, image, title or price. In the event that we cancel an order we will void or refund the payment in full. If an item's description contains an error such as incorrect price and a customer orders, we will not process the order without first contacting the customer. If the order is mistakenly shipped, we may advise the customer to return the item in unopened condition and we will not bill the customer.

Occasionally we have only one item in stock and more than one person orders it. We will honor the first funded order. If we run out of stock we will cancel your order and refund your payment in full.

By placing an order, the customer agrees that 1791 Headquarters will be the final arbiter of discrepancies in the online catalog.

• Buyer is not a fugitive from justice.

• Buyer understands that handling, cleaning, or discharging firearms, ammunition or ammunition components may cause exposure to lead. Buyer holds 1791 Headquarters harmless, and the buyer assume all responsibility for any lead exposure.
• By selling or delivering ammunition to the Buyer, 1791 Headquarters is not violating any state or local law or ordinance.

INDEMNIFICATION AND AGREEMENT TO DEFEND

I fully agree that if any of my representations when making purchases under the Terms of Sale are incorrect or if I fail to comply with these Terms of Sale, then I will indemnify, defend, save harmless, and release .com and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from my purchase from 1791 Headquarters.
